While you can legally vape in beer gardens, it’s important to be aware that some pubs may decide to prohibit vaping in these areas. Check the pub’s vaping policy with staff before using a vape.
WHAT ARE THE LAWS ON SMOKING AND VAPING IN BEER GARDENS?
Although vapes do not contain tobacco, the World Health Organisation often groups vape equipment in with tobacco products, therefore pubs can prohibit vaping in their non-smoking areas if they wish to.
Action on Smoking and Health (ASH) has requested that outdoor sites, including beer gardens, are to be made smoke-free now that lockdown restrictions have eased. However, as the organisation hasn’t clearly differentiated vaping from smoking, landlords are still unsure of whether vaping should get the green light.
The British Beer and Pub Association (BBPA) is an organisation that pub owners can turn to for guidance. However, on this occasion, the BBPA has chosen to “leave it up to the individual” when it comes to making a call on vaping on their premises.
While you can legally vape in beer gardens, it’s important to be aware that some pubs may decide to prohibit vaping in these areas. Check the pub’s vaping policy with staff before using a vape.
If they do allow vaping, be mindful of those around you; try to avoid using yours near someone who is eating or where someone will be directly on the receiving end of your vape clouds.
